1. Agreement to Terms

By accessing or using RidesPool ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

IMPORTANT: RidesPool is a ride-pooling and carpooling connection platform, NOT a transportation service or taxi service.

We are a technology platform that connects private individuals who wish to share rides and split costs. We do NOT:

• Provide transportation services
• Employ or contract drivers
• Own, operate, or maintain vehicles
• Control or direct drivers' actions
• Set mandatory pricing (drivers and passengers agree on cost-sharing)

All rides are private arrangements between individual users. Drivers are independent individuals sharing their personal vehicles, NOT commercial transport operators.

Our technology platform services include:

• Ride matching and booking platform
• Driver verification with license and photo ID checks
• Premium driver verification with enhanced AI-powered face matching
• SheSafePool: Women-only verified rides for enhanced safety
• Seat selection and booking management
• WhatsApp-based communication between users
• Email and in-app notifications
• Driver and passenger review systems
• Real-time ride updates

3. User Responsibilities

For All Users:

• You must be at least 18 years old to use RidesPool
• You must provide accurate and truthful information
• You are responsible for maintaining account security
• You must comply with all applicable laws and regulations
• You must treat other users with respect

For Drivers:

• You must have a valid driver's license
• You must have valid vehicle insurance
• Your vehicle must be roadworthy and safe
• You must provide clear photos of your vehicle
• You are responsible for all aspects of the ride
• You must verify passenger identity before departure
• You must complete verification (license upload and photo ID with face matching)
• Premium drivers must pass enhanced AI-powered face matching verification

For Passengers:

• You must arrive on time for your booked ride
• You must respect the driver's vehicle and rules
• You are responsible for your personal belongings
• You must pay the agreed-upon price

4. Verification and SheSafePool

IMPORTANT DISCLAIMER: Driver verification is provided for safety purposes and to assist law enforcement in case of incidents. Verification does NOT constitute employment screening, guarantee driver quality, or make RidesPool liable for driver conduct. Users are responsible for their own safety and due diligence.

Driver Verification:

To help promote safety and assist law enforcement if needed, drivers may complete optional identity verification including:

• Valid driver's license upload and verification
• Photo ID verification with AI-powered face matching
• Real-time selfie comparison to ensure identity authenticity
• Vehicle registration and insurance documentation
• Clear vehicle photos from multiple angles

Premium Driver Verification: Enhanced verification with stricter AI face matching thresholds. This is an optional feature and does not constitute RidesPool endorsement or liability for the driver.

⚠️ Verification is for identification purposes only. RidesPool does not conduct criminal background checks, driving record checks, or comprehensive safety screenings. You are responsible for assessing your own safety and comfort level with each ride.

SheSafePool - Women-Only Rides:

SheSafePool is our women-only ridesharing service that requires:

• Additional identity verification for female passengers and drivers
• Mandatory photo ID and face matching verification
• Gender verification through government-issued ID
• Access restricted to verified female users only
• Enhanced safety features and 24/7 support

Users who provide false information to access SheSafePool will be immediately banned from the platform and may face legal consequences.

5. Payment Terms

RidesPool is 100% free for passengers. No booking fees are charged. Payment arrangements are made directly between drivers and passengers. RidesPool is not responsible for payment disputes.

Drivers may be required to pay a small commission or subscription fee to maintain their active status on the platform.

6. Safety and User Responsibility

YOUR SAFETY IS YOUR RESPONSIBILITY. RidesPool is a connection platform only.

As a technology platform connecting individuals for ride-pooling, we:

• Do NOT conduct comprehensive background checks
• Do NOT verify driving records or criminal history
• Do NOT screen for driver competency or safety
• Do NOT supervise, control, or monitor rides
• Are NOT responsible for user conduct or safety

Users are solely responsible for:

• Assessing the safety and suitability of each ride
• Verifying driver/passenger identity before rides
• Making informed decisions about ride participation
• Their own safety precautions and risk assessment

⚠️ SAFETY RECOMMENDATIONS (Your Responsibility):

• Share trip details with friends or family
• Meet in public, well-lit locations
• Trust your instincts - cancel if uncomfortable
• Verify driver/vehicle matches listing before entering
• Keep phone charged and emergency contacts ready

Insurance: Drivers must maintain valid personal auto insurance. RidesPool does not provide, require, or verify insurance coverage. Users should verify insurance with their own insurance providers. RidesPool is not liable for insurance gaps or claims.

7. Cancellation Policy

Both drivers and passengers may cancel rides. We encourage users to:

• Provide advance notice when canceling
• Communicate directly via WhatsApp
• Be respectful of others' time

Repeated last-minute cancellations may result in account suspension.

8. Prohibited Conduct

You may not:

• Use the Service for illegal purposes
• Harass, threaten, or discriminate against other users
• Provide false information or impersonate others
• Attempt to bypass security measures
• Scrape or data mine the platform
• Post inappropriate content

9. Intellectual Property

All content, trademarks, and intellectual property on RidesPool belong to RidesPool or its licensors. You may not use our branding or content without permission.

10. Limitation of Liability

RIDESPOOL IS A TECHNOLOGY PLATFORM ONLY - WE ARE NOT A TRANSPORTATION COMPANY.

As a ride-pooling connection platform, RidesPool and North Cipher Valley Inc. are NOT responsible for and expressly disclaim all liability related to:

• Driver or Passenger Conduct: Actions, behavior, or character of users
• Accidents and Incidents: Vehicle accidents, injuries, property damage, or death
• Driver Competency: Driving ability, skill, or safety practices
• Vehicle Condition: Vehicle safety, maintenance, or roadworthiness
• Insurance Coverage: Gaps, denials, or claims related to insurance
• Verification Accuracy: False information, identity fraud, or verification errors
• Service Quality: Ride quality, timeliness, route selection, or user satisfaction
• Disputes: Payment disputes, cancellations, or conflicts between users
• Lost or Stolen Items: Personal belongings, valuables, or property
• Legal Violations: Traffic violations, criminal acts, or regulatory compliance
• Platform Issues: Service interruptions, technical errors, or data loss

⚠️ CRITICAL DISCLAIMER:

ALL RIDES ARE PRIVATE ARRANGEMENTS BETWEEN INDIVIDUALS. We merely provide a platform for connection. Drivers are NOT our employees, agents, or contractors. We do NOT provide transportation services. By using RidesPool, you acknowledge and agree that:

• You participate in rides entirely at your own risk
• RidesPool has no control over user conduct or safety
• Verification does NOT guarantee safety or reliability
• You waive any claims against RidesPool related to ride participation

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• RIDESPOOL AND NORTH CIPHER VALLEY INC. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE PAST 12 MONTHS (IF ANY)
• THESE LIMITATIONS APPLY EVEN IF RIDESPOOL HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES

11. Dispute Resolution

Any disputes arising from these terms will be governed by the laws of Canada and the province of Ontario. Users agree to attempt to resolve disputes through mediation before pursuing legal action.

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose safety risks.

13. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
